you file.

A clearance search identifies conflicting earlier marks before you file an application. It is the most important and least expensive step in trade mark registration — problems found before filing cost a fraction of those found after.

Filing a trade mark application without a clearance search is one of the most common — and most avoidable — mistakes in trade mark practice. Without a search, you risk filing directly against an existing registered mark.

The consequences can include: a registry objection during examination, an opposition from the earlier mark owner during the publication period, or an infringement claim after you have been trading under the mark and investing in your brand. The cost of any of these outcomes substantially exceeds the cost of a clearance search conducted before filing.

Our clearance search covers the Irish (IPOI), EU (EUIPO) and international (WIPO Madrid) registers, searching for identical and confusingly similar marks in the same and related Nice classes as your proposed mark. We provide a written report with our assessment of registrability and, where risks are identified, advice on how to address them before any application is filed.
