Irish trade mark
registration.

A registered Irish trade mark gives you 10-year exclusive rights to your brand in Ireland. All applications are filed directly with IPOI — the Intellectual Property Office of Ireland — at a fixed fee agreed in advance.

A trade mark registered with IPOI gives you an exclusive right to use your mark in Ireland in respect of the goods and services for which it is registered. Registration creates a public record of ownership, simplifies enforcement, and provides a basis for international filings through the Madrid Protocol.

Ireland operates a first-to-file system. The business that files first has priority — regardless of who was using the mark first. Early registration is always advisable.

An Irish trade mark is valid for 10 years from the date of filing and can be renewed indefinitely. For businesses also trading in the EU, an EU trade mark (EUTM) filed with EUIPO is generally the more cost-effective choice, as it covers all 27 member states — including Ireland — with a single application.

Note: For most businesses, an EU trade mark provides better value — one filing, one fee, 27 countries. An Irish-only filing may be appropriate where EU protection is not needed, or as a fallback if an EU application is refused. We advise on the right strategy for your business.

Clearance Search

We search IPOI, EUIPO and international registers for conflicting earlier marks and advise on registrability before any application is filed.

Class & Specification

We advise on the correct Nice class(es) and draft the specification of goods and services — the foundation of your protection.

Application Filed

The application is filed online with IPOI. A filing date and application number is assigned. IPOI fees are paid at this stage.

Examination

IPOI examines the application for formal requirements and absolute grounds. If objections arise, written submissions are prepared on your behalf.

05

Publication & Opposition

If accepted, the application is published in the IPOI Journal. A three-month opposition period follows. Any opposition is managed directly.

06

Registration

On completion of the opposition period without challenge, the registration fee is paid and the certificate of registration is issued.
